Terms of Use

These Terms of Use ("Terms") govern your use of the NEXOMATIC mobile application (the "App"), the NEXOMATIC hardware installed at your premises (the "Devices"), and the services that connect them (together, the "Service"). The Service is operated by Hasmita Agriservices Private Limited ("NEXOMATIC", "we", "our", "us"), Coimbatore, Tamil Nadu, India.

By creating an account, installing the App, or operating a NEXOMATIC Device, you agree to these Terms. If you do not agree, do not use the Service.

Your privacy is covered separately by our Privacy Policy, which forms part of these Terms.

NEXOMATIC Devices switch mains electricity. They must be installed by a certified electrician or a NEXOMATIC-trained technician.

• Do-it-yourself installation, or installation by an unqualified person, voids the warranty and is undertaken at your own risk
• Devices carry a 2-year manufacturer warranty against defects and failure under normal use: a faulty unit is replaced in the first 6 months, then repaired or replaced by our own team. Extended cover is available through our dealer network
• The warranty does not cover damage from lightning, flooding, rodents, incorrect supply voltage, unauthorised modification, or loads outside the rating printed on the device
• You remain responsible for the wiring, earthing and protective devices of the premises themselves

You agree not to:

• Use the Service to control equipment where a failure to switch, or an unintended switch, could injure someone — see section 6
• Reverse engineer, decompile, or extract firmware, keys or credentials from the Devices or the App, except where Indian law expressly permits it
• Probe, load-test or interfere with our servers, or connect unauthorised hardware to our network services
• Resell, rent or rebrand the Service without a written dealer agreement
• Use the Service to break any law, or to control another person's property without their permission

Read this section even if you read nothing else.

NEXOMATIC is a convenience and efficiency system. Smoke, gas, water, intrusion and temperature alerts are provided on a best-effort basis and depend on mains power, on your internet connection, on your phone being able to receive notifications, and on the Device itself being in working order. Any one of those can fail.

• Do not rely on the Service as a fire alarm, security alarm, medical alert, or any system on which a life or a livelihood depends
• Keep independently certified alarms where regulation or good sense requires them
• Where NEXOMATIC controls machinery, pumps, refrigeration or gates, keep the manual override and the mechanical protection that the equipment came with

Many NEXOMATIC Devices are designed to keep working with the internet down, and physical switches keep working with the App closed. That is a design goal, not a guarantee for any particular installation.

Linking a voice assistant such as Amazon Alexa is optional. If you link one, you also accept that assistant's own terms and privacy notice, and you accept that anyone within earshot of the speaker can operate the devices you have exposed to it.

• Only devices you can control are exposed. Sensors are deliberately withheld, and your automations keep running on NEXOMATIC rather than in the assistant's cloud
• Voice control needs the internet. It stops when the connection does
• You can unlink at any time from either side. What data is involved is set out in section 6 of our Privacy Policy

To the extent permitted by Indian law, NEXOMATIC is not liable for indirect or consequential loss — lost profit, lost stock, lost data, or loss arising because an automation did not run or ran at the wrong time.

Our total liability for any claim connected with the Service is limited to the amount you paid us for the Device or subscription the claim concerns, in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
